Ample Privacy Policy

Scope of this Policy
This privacy policy (“Policy”) applies to all Ample Mobile App (the “App”) users and users who visit Ample’s website (the “Site”), which is available at Ample.com. Please remember that your use of the App is also subject to our Terms of Service.
Ample was founded to accelerate the transition toward zero emission vehicles. The Ample Service (the “Service”) helps make this idea a reality. We are continually evolving our Service, and as of the date above, the Services includes Ample Battery Module, Ample Adaptor Plate, an Ample-branded Electric Vehicle, Swapping Stations, and any other related equipment provided or made available by Ample. Our Service also includes the App, all other related equipment, software, maintenance, personnel, our websites, social media assets, and any other information, technology and services provided or otherwise made available to you at our discretion.
We reserve the right to change this Policy from time to time. If Ample makes changes to this Policy, the updated Policy will be made available through our Service and if we make any material changes to this Policy, we will provide a prominent notice in the App or through another method.
The Information We Collect
When you use the App or visit the Site, we collect the information you provide, usage information, and information about your device. We also collect information about you from other sources like third-party services, which we may combine with other information we have about you. In those instances, we will use the information we collect in a manner consistent with this Policy.
Here are the types of information we collect about you:
A. Information You Provide to Us
Account Registration. When you sign up for the App, we will create information related to registering your account, including your name, phone number, and driver’s license number.
Communications. When you contact us or we contact you (either through the App or Site), we collect any information that you provide, including the contents of the messages or attachments you send us. We may also collect your email address if you sign up for our newsletter through the Site.
Job Applicants. If you apply for a job with us through the Site, we will collect any information you provide in relation to processing your job application, including your demographic information, employment history, and any information you provide on your resume.
B. Information We Collect When You Use the Service or Visit the Site
Location Information. Finding nearby Ample stations requires accurate location information. The App may collect location information (including GPS data) depending on your Ample app settings and device permissions. Please note that if you do not provide location information through your settings and device permissions, you may not be able to use the Service.
Usage Information. We collect information about your use of the Service or Site, including information like the date, time, destination, distance, or route. We also collect information about your interactions with the Service, including the screens and content you view and the dates and times of your use.
Device Information. We collect information about the devices you use to access the App or Site, including device model, IP address, type of browser, version of operating system, identity of carrier and manufacturer, radio type (such as 4G), preferences and settings (such as preferred language), application installations, device identifiers, advertising identifiers, and push notification tokens.
Cookies, Analytics, and Third-Party Technologies. We collect information through the use of “cookies”, tracking pixels, data analytics tools like Google Analytics, SDKs, and other third-party technologies to understand how you navigate through the App and interact with the App, to make your Ample experience safer, to improve your App experience, and to save your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use the App or Site. You should consult your web browser(s) to modify your cookie settings. Please note that if you delete or choose not to accept cookies from us, you may not be able to use the App or Site.
Third-party Plugins. Our App or Site may include plugins from other companies, including social media companies (e.g., the Facebook “Like” button). These plugins may collect information, such as information about the pages you visit, and share it with the company that created the plugin even if you do not click on the plugin. These third-party plugins are governed by the privacy policies and terms of the companies that created them.
Aggregated and de-identified information. From time to time, we may also aggregate or de-identify information about your use of our App or Site, such as the pages you visit or your transactions, and share that information with third parties. Such aggregated or de-identified information will not identify you personally.
C. Information We Collect from Third Parties
Third-Party Services. Third-party services provide us with information needed for core aspects of the App or Site. These third-party services include phone number verification, in-app messaging, marketing providers for push notifications, and other businesses. We obtain the following information about you from these third-party services:
- Information about you provided by specific services, such as demographic and market segment information.
Enterprise Programs. If you use Ample through your employer or other organization that participates in one of our Ample enterprise programs, we will collect information about you from those parties, such as your name,contact information, and driver’s license number (for purposes of account creation)..
How We Use Your Information
We use the information that we collect (described in “The Information We Collect,” above) for a variety of purposes. Our legal bases for processing your personal information are: 1) our legitimate interest in running and maintaining our business; 2) performance and fulfillment of our contracts; 3) your consent; and 4) compliance with our legal obligations. In many instances, more than one of these legal bases apply to the processing of your personal information.
We use your personal information to:
- Provide the Ample App or Site
- Send you information about the App or Site
- Maintain the security and safety of the Ample App and Site and their users
- Provide customer support
- Aggregate and de-identify information
- Create new products and services
- Improve the Ample App and Site, and
- Respond to legal proceedings and obligations.
How We Share Your Information
To make the App and Site work, we may need to share your personal information with third parties and service providers. This section explains when and why we share your information.
A. Sharing with Enterprise Programs
If you sign up for the App through an Enterprise Program, we may share your information with that program. The information we may share with associated Enterprise Programs includes Location Information and Usage Information (as those terms are defined above).
B. Sharing With Third-Party Service Providers for Business Purposes
- Personal identifiers, such as your name or phone number
- Internet or other electronic network activity information, such as your IP address, type of browser, version of operating system, carrier and/or manufacturer, device identifiers, and mobile advertising identifiers; and
- Location Information
We disclose those categories of personal information to service providers to fulfill the following business purposes:
- Maintaining and servicing your Ample account
- Providing you customer service
- Verifying your phone number
- Providing analytics services to Ample
- Undertaking internal research to improve the App and Site
C. For Legal Reasons and to Protect Ample
We may share your personal information in response to a legal obligation, or if we have determined that sharing your personal information is reasonably necessary or appropriate to:
- Comply with any applicable federal, state, or local law or regulation, civil, criminal or regulatory inquiry, investigation or legal process, or enforceable governmental request;
- Respond to legal process (such as a search warrant, subpoena, summons, or court order);
- Enforce our Terms of Service;
- Cooperate with law enforcement agencies concerning conduct or activity that we reasonably and in good faith believe may violate federal, state, or local law; or
- Exercise or defend legal claims, protect against harm to our rights, property, interests, or safety or the rights, property, interests, or safety of you, third parties, or the public as required or permitted by law.
D. For Analytics
Analytics. We partner with certain third parties to obtain the automatically collected information discussed above and to engage in analysis, auditing, research, and reporting. These third parties may use pixels or server logs, and they may set and access device IDs and IP addresses from your device. Specifically, our Site uses Google Analytics for the above purposes. You can learn about how Google Analytics uses data when you access our website here, and can opt out of being tracked by Google Analytics across all websites here.
Please note that the App and Site currently do not respond to “Do Not Track” signals.
Interest-based Advertising. The Site enables third-party tracking mechanisms to collect information about you and your computing devices for use in online interest-based advertising. For example, third parties may use the fact that you visited our website to target online ads to you. In addition, our third-party advertising networks might use information about your use of our website to help target advertisements based on your online activity in general. For information about interest-based advertising practices, including privacy and confidentiality, visit the Network Advertising Initiative website or the Digital Advertising Alliance website.
The use of online tracking mechanisms by third parties is subject to those third parties’ own privacy policies, and not this Privacy Policy. If you prefer to prevent third parties from setting and accessing cookies on your computer or other device, you may set your browser to block cookies. Additionally, you may remove yourself from the targeted advertising of companies within the Network Advertising Initiative by opting out here, or for companies participating in the Digital Advertising Alliance by downloading their WebChoices or AppChoices tools here.
If you use the Site through your mobile device, you may also opt out of interest-based advertising by adjusting the advertising preferences on your mobile device (for example, in iOS, visit Settings > Privacy > Advertising > Limit Ad Tracking, and in Android, visit Settings > Google > Ads > Opt out of interest-based ads).
How We Store and Protect Your Information
We retain your information for as long as necessary to provide you and our other users the App and Site. This means we keep your personal information for as long as you maintain an account. We retain transactional information such as battery swaps for at least seven years to ensure we can perform legitimate business functions, such as accounting for tax obligations. If you request account deletion, we will delete your information as set forth in the “Deleting Your Account” section below.
We take reasonable and appropriate measures designed to protect your personal information. But no security measures can be 100% effective, and we cannot guarantee the security of your information, including against unauthorized intrusions or acts by third parties.
Your Rights And Choices Regarding Your Data
Messages: You may opt out of receiving marketing emails and text messages from us by following the instructions in those messages or by emailing us at: privacy@ample.com
Push Notifications. You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications may impact your use of the Ample App (such as receiving a notification that your battery swap is complete).
Location Information. You can prevent your device from sharing location information through your device’s system settings. But if you do, this will impact Ample’s ability to provide you our full range of features and services.
Updating or Deleting Your Information: If you would like to update, change, or delete any information we have on file, you may do so through the App or by contacting us at: privacy@ample.com.
Deleting Your Account. If you would like to delete your Ample account, please contact privacy@ample.com. In some cases, we will be unable to delete your account, such as if there is an issue with your account related to trust, safety, or fraud. When we delete your account, we may retain certain information for legitimate business purposes or to comply with legal or regulatory obligations. When we retain such data, we do so in ways designed to prevent its use for other purposes.
Exercising Privacy Rights. If you are a resident of a jurisdiction with an applicable data privacy law, you may have certain rights available to you in relation to your personal information. These rights may include:
- The right to access your personal information (including a data portability request);
- The right to correct or amend any personal information we have on file about you;
- The right to delete your personal information;
- The right to limit the use of your “sensitive” personal information;
- The right to opt-out of the sale or “sharing” of your personal information;
- The right to opt-out of the use of your personal information for targeted advertising purposes;
- The right to restrict or object to the processing of your personal information (such as for direct marketing purposes);
- The right to restrict or opt-out of the use of your personal information for certain automated decision-making (including profiling in furtherance of decisions that produce legal or similarly significant effects);
- The right to revoke your consent (to the extent applicable);
- The right to confirm whether personal information about you is being processed;
- The right to obtain a list of specific third parties (or categories of third parties) to which we have disclosed your personal information or any personal information; and
- The right to lodge a complaint to your local data protection authority.

We will respond to your request as soon as reasonably possible and within the timeframe required under applicable law. We will allow you to appeal any decision we make in response to such request in accordance with applicable law. Appeals may be submitted to privacy@ample.com with the subject line “Appeal of Decision Related to Privacy Rights Request.”
Prior to complying with your request, we will first verify your identity by comparing the information you provide with the information we have on file for you.
You may authorize an agent to make a request on your behalf. To designate an agent, please provide a written and signed document by both you and the agent that authorizes the agent to act on your behalf. You may also use a power of attorney. We will still require you to provide information to allow us to reasonably verify that you are the person about whom we collected personal information.
Links to Third-Party Websites
The App or Site may contain links to third-party websites. Those websites may have privacy policies that differ from ours. We are not responsible for those websites, and we recommend that you review their policies. Please contact those websites directly if you have any questions about their privacy policies.
International Users
The information that we collect through or in connection with the App is transferred to and processed in the United States for the purposes described above. We also may subcontract the processing of your data to, or otherwise share your data with, affiliates or third parties in the United States or countries other than your country of residence. The data-protection laws in these countries may be different from, and less stringent than, those in your country of residence. By using the App or by providing any personal or other information to us, you expressly consent to such transfer and processing.
Children
Content on the App and Site is directed at individuals over the age of 18 and is not directed at children under the age of 16. We do not knowingly collect personally identifiable information from children under the age of 16.
